This info about BO's birth cert. came across on email. What struck me were several things:

Barrack Obama came across on the official paper in 1961 as African American as this term was not politically correct until the 1990's.
The country of Kenya was not established until 1963 yet Barrack Obama born 1961 to a man listed as from a county that did not exist.
The name of the Hospital that BO was born in changed in 1978. The current hospital name was listed on the birth cert. for BO although in 1961 is was different than it is today.

Footnote: I live in a county which was established March 3, 1893 by Montana Legislature but the county seat was formed in 1894 without required paperwork.

It was brought to light that back in 1961 people of color were called
'Negroes.'
So how can this 'birth certificate' state he is 'African-American'
when the term wasn't even used back then?? This isn't over! This is
interesting!

"As you all know, Donald Trump made a big deal about Obama's birth certificate.

I will tell you right now that I had never given this "birther" issue
any credit. I watched the hype and the crazies come out. I completely
dismissed the entire
ordeal altogether.

In fact, it was not until the White House released the birth
certificate that it gained my attention. I am the studious sort of
guy, and I have plenty of time on my hands. So, I took a close look at
this document.

While I would have thought that this issue would have been closed for
good (and, got the crazies to crawl back into their holes), I found
two extremely strange inconsistencies that merit some attention.

First of all, the birth certificate that the White House released
lists Obama's birth as August 4, 1961. It also lists Barack Hussein
Obama as his father. No big deal, right? At the time of Obama's
birth, it also shows that his father is aged 25 years old, and that
Obama's father was born in " Kenya , East Africa ".

This wouldn't seem like anything of concern, except the fact that
Kenya did not even exist until 1963, two whole years after Obama's
birth, and 27 years after his father's birth. How could Obama's
father have been born in a country that did not yet exist?

Up and until Kenya was formed in 1963, it was known as the " British
East Africa Protectorate". But, this is not the only thing that I
found that just does not jive.

The second item that I looked into was the hospital that Obama was
born in. On the birth certificate released by the White House, the
listed place of birth is
"Kapi'olani Maternity & Gynecological Hospital ".
This cannot be, because the hospital(s) in question in 1961 were
called "Kaui Keolani Children's Hospital" and "Kapi'olani Maternity
Home", respectively.

The name did not change to Kapi'olani Maternity & Gynecological
Hospital until 1978, when these two hospitals merged. How can this
particular name of the
hospital be on a birth certificate dated 1961 if this name had not yet
been applied to it until 1978?

Go ahead, look it up. I am not talking crazy talk....these are the
facts. Like I said, I thought that this was a non-issue until the
actual certificate was released. Now that it has been released, of
course I had to look into it. I have found these issues, now I know
that something is up. If you doubt me, just look at the following

Ravalli County governments

This letter will look at how well our governments are working in Ravalli County, without the party spin, but with hard facts, and hard truths. Some might remember the documentary commissioned and filmed in the Bitterroot Valley in 2009 named “Beneath the Beauty”. Within that 2 hr. production the Mayor of Hamilton, Jerry Steele is asked about incorporation documents for his city, required for public inspection in Montana under MCA 7-2-4100 and following.

The public inspection issue is a problem for our local governments. As many people work for these governments, all of a sudden it has become “all of them” against an individual, or smaller group of people. This newspaper has bravely entered the courts to attempt to warm the heart of Honorable Langton, personally I tried with Honorable Haynes to plead public disclosure of police reports which outweigh personal privacy of an individual, even if they work for a local government. The constitutional right to know is a powerful one in Montana, and our local governments don’t have a terribly good track record if you look at the filing history in the Montana Supreme Court.

In 2006 a person named Prindel sued Ravalli County for not releasing documents, and records the failure to release public information. In 1992 it appeared that the Hamilton City Judge was sexually harassed by the sitting Mayor Whitlock, and a group called Citizens to recall Whitlock sued the Mayor to release the investigation due to public concern of the document. The Bitterroot Star, and others sued the County for the release of Geoff Mahar’s complaint against the Ravalli County for similar reasons.

Why do our local governments behave so badly? It’s due to the “all of us” against the individual mindset. The interesting part is the admission in official meeting of Mayor Steele in August 2009 of no incorporation public documents for the City of Hamilton. The official plat map indicates the City of Hamilton was annexed to Missoula Co. on September 4, 1890, with no record of incorporation since. Ravalli County was created by the Montana Legislature on March 3, 1893 except that Hamilton relies upon a newspaper article from July 21, 1894 as proof of “incorporation”. Neither the current city clerk nor county clerk can find required public documents for Hamilton’s lawful incorporation. How can these local governments lawfully collect taxes or have employees, elections or any function of a government such as courts, law enforcement?

Montana law MCA 7-2-2103 says that a county seat such as Hamilton must be incorporated for a county to lawfully exist. Seeing how the chicken came before the egg for Ravalli County (county created 1893 prior to “incorporation” in 1894 or Marcus Daly founding in 1895) do we wonder why our local governments are behaving so badly? It’s because they don’t lawfully exist, and they don’t need to behave or follow the rules.

Open meeting laws, public disclosure of information, partisan infighting, potential issues with civil rights; all due to no desire to be lawful. If we want less government intrusion, public officials can decide to put their pencils down, and stop collecting our taxes. Seeley Lake is a wonderful place to live, because Missoula Co. leaves them alone. With proof that Missoula Co. owns Hamilton, and Ravalli County cannot exist without a legitimate county seat, it’s time to get out the drawing board and chalk out some lawful solutions for our local governments to exist in the Bitterroot Valley.

On the heels of slamming the Ennis Montana School District Superintendent for improper use of public funds (something Steve Bullock is expert at) he gets the school union endorsement in Montana. Some thing does not add up here for the MEA-MFT CORE union headed by Eric Feaver in Helena.

What does make sense is Democratic operatives such as Jim Messina "from Montana" pressuring the union to back Bullock. The question is, do Montana Voters follow unions endorsements into the voting booth? It would be a hard sell to elect a Democrat in any state in the Union after the 2010 windfall for the other corporate party.

Can't other educators in Montana figure out that this "endorsement" came pretty high up if the same news cycle has a superintendent trashed by Steve Bullock.

This cause of action is for violation of the National Environmental Policy Act (NEPA) as described in 42 USCA §4332 et. seq.; 40 CFR §1502 and §1503 et. seq. Defendants failed to follow well established guidelines for NEPA, and assess health and safety risks at National Institute of Health facility in Hamilton, Montana known as Rocky Mountain Labs (RML).

Plaintiff Michael Spreadbury (hereafter “Plaintiff”) in his complaint against US Department of Health and Human Services et. al. Defendants allege as follows:

Parties:

1. Michael Spreadbury, a resident and natural person of the State of Montana.

2. The US Department of Health and Human Services, an executive branch department of the United States which must abide by all applicable laws.

3. National Institutes of Health (NIH), a branch of the US Department of Health and Human Services must act in compliance with all applicable laws, based in Bethesda, Maryland.

4. Francis Collins, Director of the National Institutes of Health, the responsible official who must act in compliance with all applicable laws, based in Bethesda, Maryland.

5. Marshall Bloom, Director of Rocky Mountain Labs (RML) affiliated with NIH, is the local responsible official for who must abide by all applicable laws, located in Hamilton, Montana.

Jurisdiction and Venue:

The Montana US District Court has jurisdiction via 5 USC s. 701 et. seq., 28 USCA 1331 Federal Question, 28 USCA 1336, 28 USCA 2201 et. seq. Declaratory Judgment Act. NEPA 42 USCA § 4332 et. seq., 40 CFR §1502, §1503 et. seq. Plaintiff entitled to relief.

Venue is proper due to Defendant property and activities in Ravalli County Montana which is within the Missoula Division of the US District Court for Montana.

Factual Background

The Bitterroot Valley, where the Rocky Mountain Laboratory is located contains blue ribbon trout rivercourse Bitterroot River containing protected Species Bull Trout.
Lewis & Clark traversed valley upon direction of US President to find a land route to the Pacific Ocean.
Soils in the Bitterroot Valley are some of the richest in the state; water, timber resources abound surrounding the NIH facility in Hamilton, MT.
The Selway-Bitterroot Wilderness is the second largest in the US at 1.6M acres, which sits at the western boundary of the RML site in Hamilton, MT.
Wildlife crossings in ,Bitterroot are essential to habitat such as Bear, Moose, Elk, Deer, bird habitat of waterfowl, migrating birds, owls, hawks, bald eagles.
RML site in floodplain for flood insurance: any part of property below the 100 year floodplain makes entire property floodplain, 1968 National Floodplain Insurance Act.
Neighborhood surrounding RML south of Hamilton, MT contains historic homes over 40 years which require historical review for any federal project by NIH.
NIH-RML drafted an Environmental Impact Statement (EIS) and Final EIS (FEIS) with appropriate comment period.
NIH-RML drafted a 20 year master plan with appropriate comment period.
Specific details for Interpretive Center and North Parking Lot projects in FEIS did not include required items as per the National Environmental Policy Act (NEPA).
NIH-RML FEIS did not include alternatives to interpretive center project.
FEIS did not include a historical review in report specific to the interpretive center, proposed parking lot project, purchasing residential property for NIH industrial use.
FEIS did not allow public comment addressing the interpretive center, or the parking lot project specifically as proposed.
Proposed Parking Lot project is near floodplain and drainage to Bitterroot River, and would require use of residential property purchased for a federal industrial purpose.
Interpretive Center proposed demolition is within a historic residential area did not include alternatives to the proposed demolition of the existing structure 801, 803 S. 4th.
In planning the new BSL-4 facility, NIH did not include professional fire, material safety personnel or fire structure assets at RML for safety, health of residents, employees.
The 20 year plan and FEIS does not include an emergency response structure at RML.
RML agreed to respect NEPA process, and uphold health and safety of community and RML employees in 2004 to resolve CV-04-154-M-DWM out of court.
NIH BSL-4 facilities in Frederick, MD; Bethesda, MD; and Raleigh-Durham, NC have sufficient fire assets due to being in larger communities which have training and equipment necessary to provide emergency assistance to comparable facilities to RML.
RML is located in an isolated valley with no professional fire departments, and no material safety teams within 45 miles, and 29 volunteer firemen in Hamilton, MT.
NIH headquarters house 30 federal firefighters, and can get assistance from the well equipped Bethesda (MD) Fire Department, located within 15 minutes from D.C. metro.
RML has no federal or professional fire personnel in any proximity to facility.
RML 20 year plan had no onsite emergency response facility although no adequate biological, materials, or radiological safety team is within 45 miles.
First Presidentially declared fire emergency was in proximity to RML, Ravalli County, and Montana in year 2000. Fire hazard is extremely high near RML.
RML is 45 miles from Missoula, MT with 60,000 residents and five firehouses. Materials safety team is currently dispatched from Missoula Fire Department.
Fallen timber block fire corridor route, accidents, and in-climate weather 3000 ft. AMSL, 47°Latitude; fire/materials response from Missoula not assured within 1 hour of dispatch.
RML without professional material safety, biological, or radiological staging area available on site, or within 45 miles of the Hamilton, MT facility.
NIH Office Research Safety issued Plaintiff false assurances of safety since 2007.
Plaintiff has adequately participated in administrative process by expressing concerns to RML, NIH in fire safety, environmental quality, NEPA director, Director of Research Safety, NIH legal counsel, and NIH Directors office.
Plaintiff has offered mediation to resolve this dispute to NIH.
No further remedy is available to Plaintiff to resolve NEPA and related safety issues.
FEIS and published NIH documents failed to adequately disclose, analyze, and assess environmental risk from proposed interpretive center demolition, parking project proposed by RML.
Risks from RML proposed interpretive center, parking lot projects have impacts to the environment, human health, and impacts to local governments.
Defendants did not comply with the NEPA act at RML.
Defendants have duty protect safety and health of employees, public around RML.
Defendants failed to answer electronic correspondence from Plaintiff addressed to askrml@niaid.nih.gov relating to fire safety.
Defendants do not pay taxes to local governments, nor payment in lieu of taxes (PILT) to defray wear on roads, fire response, and other costs.
Defendants are adding lab space at RML requiring more water resources, and have not addressed resource issue in the master plan, FEIS, or other published NIH documents.
Water discharge from RML facility, or monitoring is not published or public information.
Security of RML north boundary is substandard as non-fortified chain-link fencing.
Purchase of residential property for RML is not proper for federal industrial projects.
Industrial process as RML requires roof cooling fans, which impact bird habitat, and riparian, river area to west and surrounding RML and was not addressed in FEIS.
Use of NIH police vehicles except official use, outside RML property, improper.

Charges:

Failure to consider a reasonable range of alternatives—Count 1

50. NEPA requires NIH to consider alternatives to recommended courses of action in any proposal 42 USCA §4332(2)(E).

NEPA requires NIH to prepare a detailed evaluation of all reasonable alternatives to the proposed action in every EIS. 42 USCA §4332(C)(iii); 40 CFR §1502.14(a)
Defendants consideration of a single action alternative does not satisfy the requirement that an agency prepare a detailed evaluation of all reasonable alternatives.
Failure to develop and consider reasonable alternatives by NIH with respect to the demolition of a dwelling, and a parking lot project is a violation of the NEPA Act.

Failure to Disclose Substantive Information Regarding the Proposed Action—Count 2

54. Plaintiff repeats and realleges paragraphs 1-53 of this complaint as if fully set herein.

55. Defendants did not disclose impacts to the public about proposed parking lot project, interpretive center project, within EIS for public comment.

56. No alternative was presented to local fire services in 20 year plan, or current expansion.

57. Impacts to demolishing duplex residential dwelling at 801 and 803 So. Fourth St Hamilton, MT for RML interpretive center was not published in FEIS.

58. No alternative was presented for interpretive center or parking lot proposed projects.

59. Water use in further expansion of RML post BSL-4 has not been disclosed.

60. As a result of Defendants not disclosing substantive information, NEPA violation exists.

Failure to respond to comments-- Count 3

62. Defendants have a responsibility within NEPA to adequately respond, and take into account correspondence from the public from EIS comments as in 40 CFR §1503.4

63. Plaintiff comment and Public comments as to material, biological, and fire safety at RML were not adequately and meaningfully responded to in NEPA process by Defendants.

64. False assurances to safety by NIH did not adequately address public concerns.

65. RML did not respond to questions from Plaintiff and public regarding fire safety at RML.

66. Defendant’s failure to adequately respond to, or incorporate public comments into a FEIS process is a violation of NEPA.

Failure to protect federal employees and general public—Count 4

68. Defendants planned, and built level 4 BSL in Hamilton, MT at RML.

69. Increased dangers to employees and public were not met with sufficient resources to protect federal employees, federal property, and US Citizens residing near RML.

70. NIH did not treat RML equally in respect to health and safety as compared to other BSL-4 labs in other locations of the United States with respect to fire and materials safety.

71. Due to a failure of NIH to protect employees and the general public at RML, no fire assets or structures were built or planned as published in 20 year master plan and FEIS.

Lack of Disclosure in EIS and Mater Plan Documents—Count 5

73. Fire capabilities for local volunteer departments are not published in RML documents.

74. Volunteer fire departments do not protect other NIH facilities with BSL-4 labs.

75. The lack of disclosure by NIH of fire capabilities for RML does not meet duty to assess health and safety risks to the public, as found in NEPA laws.

76. Due the lack of disclosure by NIH, RML is not sufficiently protected as well as other BSL-4 laboratories in the United States.

Negligence—Count 6

77. Plaintiff repeats, realleges paragraphs 1-76 of this complaint as if fully set herein.

78. Defendants planned BSL-4 structure five years prior to construction at RML.

79. No fire facility was planned within the campus at RML although no professional fire or fully equipped hazardous materials safety team is available within 45 miles of RML.

80. By working with high level pathogens with no known cure or vaccine, without fire and materials safety infrastructure on, or near RML campus, Defendants were negligent in their duty to protect the public and RML employees.

81. Defendants knew or should have known that RML had less fire safety available to it than other NIH facilities with BSL-4 labs on their campuses.

82. Defendants are negligent in not planning or building sufficient fire assets at RML.

Failure in Scientific Integrity—Count 7

83. Plaintiff repeats, realleges allegations in paragraphs 1-82 as if fully set herein.

84. The failure to disclose and assess health risks constitutes a failure to satisfy the standard of scientific integrity, a violation of NEPA 42 USCA §4332 et seq, 40 CFR §1502 §1503.

85. Defendants did not disclose specific facts about fire capability, specifics about Hamilton Volunteer Fire, type of engines, type and frequency of calls, required training, average age & physical condition, requirements for volunteers, capacities and age of equipment.

86. NIH did not publish alternative to use of volunteer fire departments to protect RML.

87. Vagueness of FEIS, Master Plan, Defendants gave arbitrary and non-specific information on biological, fire, material, and radiological safety at RML.

88. NIH failed to give specific information for scientific integrity with respect to NEPA required documents such as FEIS, projects, and fire operations for RML.

Disregard for Process—Count 8

89. Plaintiff repeats, realleges paragraphs 1-88 of this complaint as if fully set herein.

90. Defendants did not use EIS process to evaluate alternatives, gain comment from process, limit impact to environment on federally funded projects, but a means to gain the desired outcome of publicly owned resources.

91. Federal regulations state EIS “shall serve the means of assessing the environmental impact of proposed agency actions rather that justifying decisions already made. 40 CFR §1502.2 (g).”

92. Federal agencies “shall not commit resources prejudicing selection of alternatives before making a final decision. CFR 40 §1502(f).”

93. Defendant NIH did have a disregard to EIS process with respect to Interpretive Center, Fire resources, and proposed parking lot at RML.

Non-disclosure of Natural Resource use—Count 9

94. Plaintiff repeats, realleges paragraphs 1-93 in this complaint as if fully set herein.

95. RML uses resources from the public like water without delineating use.

96. The proposed expansion of RML will demand more water resources.

97. By not tracking, and publishing these figures, NIH is not upholding its duty to the public to wisely use local resources, or explain its use to public.

98. RML does not publish water quality figures after treatment, and release into the Bitterroot River in Hamilton, Montana.

99. RML has a duty to assure the public that the post-process water quality is below allowable levels, and is within tolerable limits of environmental protection.

100. Resource use is an impact to a community, and NIH has an obligation to the public via Federal Regulations and NEPA laws to disclose specifics on use, and protect resources from over-extraction, and assurances of best use practices.

Negligent disclosure of Environmental Impacts—Count 10

102. NIH, in FEIS did not disclose impacts all impacts to wildlife at RML.

103. FEIS stated 100 species of birds surrounding lab, yet published no impact to Riparian area due to no building in those zones on NIH property at RML.

104. NIH knew or should have known that impacts to wildlife would occur due to expansion and further expansion of the RML campus to add laboratory buildings.

105. NIH knew or should have known that an industrial campus near a wilderness river area and natural sanctuary for wildfowl on RML property would cause impacts.

106. NIH was negligent in disclosing environmental sensitive areas on the RML campus.

Misrepresentation of safety facts, environmental impacts at RML—Count 11

108. NIH did not disclose fire safety statistics, fact that no comparable NIH BSL-4 facility is protected by volunteer fireman in the United States.

109. NIH did not disclose impacts, alternatives to certain projects planned at RML.

111. NIH did not mention impacts for wildlife, or impacts to proposed projects.

112. NIH did not reveal land purchase expansion is zoned residential for planned federal industrial use for RML.

Relief Sought from Court

Plaintiff respectfully requests that Court will find declarative ruling that the Defendants have violated the National Environmental Policy Act (NEPA), or other violations in all or part of this complaint herein.

Additionally Plaintiff requests US Magistrate to:

I. Issue temporary injunctive relief to enjoin Defendants to immediately raise fire assets of RML to the standard of other BSL-4 laboratories in the United States.

II. Enjoin Defendants with cease order to stop building, on other projects at RML so fire protection can be brought to a suitable level consistent with relief sought in I.

III. Make declarative judgment whether Defendant federal agency can purchase private zoned residential property for use as federal industrial property at RML.

IV. If affirmative in III, enjoin Defendants to re-issue EIS process to include alternatives, public comment, and other NEPA requirements on proposed parking project at north central portion of RML site, and interpretive center project.

V. If negative in III, enjoin the Defendants to maintain the integrity of the historical neighborhood at RML main entrance and refrain from the proposed interpretive center project, and parking lot project at north central RML property.

VI. Enjoin Defendants to secure flood insurance for all structures on RML required by National Flood Insurance Act of 1968 per US Congress Legislation.

VII. Enjoin Defendants to regularly disclose to the public water use, expected water use, treatment standards, and contaminant levels of effluent discharged into the Bitterroot River at Hamilton, MT.

VIII. Issue permanent injunction to enjoin Defendants to prepare an EIS which follows the NEPA law to the benefit of the public with respect to the Interpretive Center, impacts to wildfowl, and all future and current federal projects at RML.

IX. Plaintiff asks court to grant any costs that arise from this action.

X. Plaintiff yields to court any further relief court deems proper in this action.

It's unfortunate that I have to write this letter, however in light of current events it is inevitable. Just days ago the United States Congress passed the NDAA (National Defense Authorization Act) this in itself was necessary. However in this bill was an insidious piece of verbiage that for all intents and purposes destroys the foundation of everything we believe in and took an oath to uphold. To me the possibility of those citizens and others under my protection being spirited off in the middle of the night by agents of the military, then being summarily incarcerated without access to judge or jury are insufferable and intolerable acts.

It will be argued that this only applies to foreign persons or others suspected of terrorism, but there are far too many avenues available to apply this to any group to which any administration may take umbrage with. When growing up and especially during our training in the academy we are instructed that the constitutional rights of all must be upheld at all times, as well as the respect for all people we come in contact with or represent. This section of the NDAA attempts to remove those rights which are enumerated and given to us by our creator, and places them in the hands of the office of the President of the United States to be disregarded at his whim.

And in those few words lies a conundrum, do we as police officers, sheriffs, deputies and others who have taken the oath to uphold and defend the constitution, now turn our back on that very oath? Do we now turn against the very same people that entrusted us with a most sacred duty to serve and protect them? If in fact we follow a rule of law such as this bill enacts, it would mean that the oath that we all took meant nothing. We are obliged to follow all lawful orders given to us, but we cannot do this blindly. History has seen the result of these acts and has judged them accordingly. I can only ask all of you to take a moment to reflect upon all that we are taught and hold dear, the people we serve deserve and demand our highest respect for it is through them and they alone that we were given this oath. Do we simply turn a blind eye for the sake of political expediency and lose our respect? Is a few pieces of silver so dear that we would sell our honor for it? How will we explain to our friends and loved ones why members of our community were spirited away or how will they see us when they realize (that when their time comes) we won't be there for them?

I believe that if and when those orders come, I cannot in good faith and in strict observance to my oath, allow myself to be a part of them. I would hope that members of our military in accordance to the articles of the UCMJ, would also refuse them as well. When that time comes I will do exactly as I have sworn to do, I will serve and protect those under my care, so help me God.

Katherine Issacson's support services is apparently going lock-step with the corruption and incompetence in Montana, and failing to protect confidential information of her clients. Notice how even the dog is turning away from Katherine Issacson, Director of Riverfront Counseling in Hamilton.

As a subpoena requested confidential information, Katherine Isaacson LCPC did not protect her patients information, and should not be given employment anywhere else other than Riverfront Counseling Services in Hamilton, MT. To clarify the individual, Ms. Isaacson formally worked in Bozeman, MT prior to taking employment at Riverfront in Hamilton, MT.

A source to this blog network has informed us that Ms. Isaacson does not like to adhere to established policy at Western Montana Mental Health Center as staff meetings were conducted, and as the kinks were worked out for the new crisis facility, West House. There is a printed, in house policy that information is only released by way of lawful process. Apparently, Katherine Isaacson LCPC "support services" at Riverfront was to give up information on counseling goals, prescription scripts, and diagnosis of her patients. Ms. Isaacson may have violated state law in denying services to the patient whose confidential information was released, a retaliatory and punitive action which only caps her unprofessional actions at a licensed, and "professional" counselor in Montana.

This is not the first time confidential information has been released by Riverfront Counseling Service of Hamilton, MT. A former Mayor, Jessica Rendazzo, working as a Counselor at the facility Isaacson heads suddenly quit the Mayor's office and subsequently released FALSE confidential information in Hamilton, MT community. The general understanding of probation officers is that they need reasonable suspicion of a violation of probation, or unlawful activity to request entry of your house [I provide the written contract (published below) with my household].

Kristina Bessenyey does not need such understandings.

Should a police chief be standing in your parlor if there is nothing wrong, how about a Detective? In the unchecked world of Kristina Bessenyey, this is a natural and wonderful consequence of too much power. In this post, we are going to explore the goals, ethics, and policies of the Montana Department of Corrections, and how Kristina Bessenyey, is completely off the map with respect to these documents. Her superiors in Helena, MT do nothing with written complaints, so this is being taken to a world audience; it should be noted that Ms. Bessenyey's supervisor, Ron Alsbury has covered for Kristina Bessenyey violating policy, a judges order, amongst other things.

Not only does Kristina Bessenyey abuse the public (not a goal of the Montana Department of Corrections) but she abuses her co-workers with condescending speech, and even discriminating remarks to other women: an EO complaint was filed by the receptionist in Hamilton; she has not been seen since.

The Job description asks for a person with "people service skills" which apparently means entering without the proper authorization, and harass with law enforcement.

Notice on here, that a good communicator is required, one that can provide documents, policies, when a probationer is confused about the process. Kristina Bessenyey communicates with the local law enforcement to harass, and intimidate the "offender". Who is being offensive in this situation?

This is the only document that was provided to my household about searches. It says a reasonable suspicion of violation is the only time. The 4th Amendment, if it still exists, says no unreasonable searches by Kristina Bessenyey in color of law (thats wearing a badge, under authority of state government).

Remember, I asked Kristina Bessenyey for a policy that allows her to enter my house. The supervisor over Ms. Bessenyey said it was "watery" or "undefined". It looks pretty clear to me: you have to suspect criminal activity, or contents not allowed: weapons, pepper spray to protect from bears while hiking, bongs, etc. The worst part, as you can see in the video above, Kristina Bessenyey brought a subordinate to teach them how to violate rights as an officer under color of law. You act under the law, the constitution, not above them Ms. Bessenyey.

I had asked for a policy that describes the initial process paperwork that the sentencing judge specifically described as not needed. The Montana Department of Corrections policy for this is P&P 30-1 and it spells it out very clearly: the Probation officer is responsible for the post sentence investigation. Ms. Bessenyey had me fill out the Pre-Sentence documents (ordered not needed by the Judge) in a forceful and confrontational manner. Kristina Bessenyey is not subject to Department Policy, Judge Order, or the US Constitution in Hamilton Montana.

It helps to be above the laws and constitution when your family friend is your boss, or the Montana Department of Corrections Probation and Parole Division. Kristina Bessenyey is a descendant of the late Marcus Daly (namesake of Marcus Daly Memorial Hospital in Hamilton, MT; Daly Mansion State Historic Site). Ron Alsbury covered for Kristina Violating Policy 30-1 for the Montana DOC, which is covering for criminal conduct per Montana Code Ann. 45-7-309(c) above.

The receptionist who filed an Equal Opportunity complaint on Kristina Bessenyey and never seen since, said Ron Alsbury Division Chief of Probation had a meeting in Hamilton with the employees and Kristina Bessenyey gave all the right answers which made the receptionist sick to her stomach. The other probation officers in the Hamilton officers feel she talks down to them, disrespectfully. Lets look at some more critical documents that Kristina Bessenyey is supposed to uphold, and doesn't:

Kristina Bessenyey, Supervisor of the Hamilton Montana Probation and Parole office violates public trust by showing up to a house without reasonable suspicion, then uses abuse of power (Amendment 14, US Constitution) with too much presence of law enforcement, officers in color of law. Ms. Bessenyey on two occasions misled, and did not give Department policy [because she was violating it]. The goals are to provide timely, accurate information [like when you are attempting to visit a house].

Instead of helping probationers succeed, Kristina Bessenyey does her best to "revoke" them, intimidate them, and mislead them. Professionalism to Ms. Bessenyey means abuse of power, intimidate, and manipulate offenders by playing on their fears of returning to prison, or threat of law enforcement involvement. Personal responsibility means do what you want to Kristina Bessenyey, without any respect for rights, laws, or policy of the Department that she works for.

[Post Publication add]: Kristina Bessenyey went upstairs to my bedroom alone, out of sight from the subordinate Probation Officer. While filming, notice the subordinate had a hand on her gun; is this how Kristina Bessenyey trains her subordinates or searches homes? See 30 sec. video above.

Bessenyey knows no such ethic.

As a former teacher and decorated FEMA officer (with a national security clearance), I would not classify Kristina Bessenyey as someone with honesty, integrity, or impartiality something contained within her Department's Code of Ethics. Ms. Bessenyey does not have respect for her colleagues, nor treat people with dignity, respect, or compassion. Ms. Bessenyey in her capacity as Supervisor of the Hamilton Montana Probation office uses fear, and outside of her job descriptions listed here.

Ms. Besenyey vows to not discriminate against any probationer, AND DOES.

Kristina Bessenyey vows to not demean offenders or probationers, AND DOES.

Ms. Bessenyey vows to uphold the US Constitution, and performs an unlawful search, one that does not offer equal protection to the probationer, as compared to other probationer.

Kristina Bessenyey will conduct herself in a manner that will not discredit or embarrass the Montana Department of Corrections......AND DID. [see video at top of post].

Prior to working in the White House Jim Messina was chief of staff for US Senator Max Baucus the Democrat from Montana who arrests Medical Doctors who have opposing views to Obamacare.

The national health care which might spark civil unrest if imposed on the American people in 2014 has been deemed unconstitutional in the US Justice System.

A woman named Melodee Haynes was shagging US Senator Baucus, 15 years his junior and acted as State Chief of Staff in Montana for Max Baucus. Ms. Hanes is now Mrs. Baucus. In a spring 2009 Democrat diner which Jim Messina attended, he explained to the KPAX-8 CBS affiliate in Missoula Montana that Max Baucus "...was like a father to me." Well if Max was like a father to Jim Messina, then Melodee was like a mother to Jim Messina....all in the Political Montana family. Amongst other things, President Obama brought the Montana Ideology, and Jim Messina as staff into the White House. The Montana ideology does not include Constitutional Rights, as will be shown in our letter to 44 linked below. Jim Messina was integral in stopping civil rights requests from the first African American president from Montana.

In the fall of 2007 I got a call from Melodee Hanes explaining that a request for a congressional inquiry into civil rights in the State of Montana. At that time Jim Messina was Baucus's chief of staff over Melodee Hanes. Melodee was a complete hissy; totally unprofessional on the phone to a constituent. It all made sense; Melodee Hanes was emotionally attached to Max Baucus and took it personally that a civil rights request was made of her Beau: Max Baucus. Due to the telephone misconduct, I inquired as to the superior of Melodee Haynes: it was revealed as Jim Messina.

So I write a letter to Jim Messina in Washington, DC. Since Jim Messina has no other experience in any profession other than politics since college, he was too important for a lowly constituent. Little did I know he was tapped for work in the White House as 'The biggest loser' to have worked there.

Funny, reading through this letter to Jim Messina of "Montana" it appears that this "man" is very good at covering political tracks. Mr. Messina decided to remove Deputy Director Powers from the Federal Bureau or Investigation (FBI) as he was interested in our letter to the US President:

It only proves that Jim Messina can spin any situation, and convince an under-educated populace that the first African American President who ignored a request for civil rights should be reelected in 2012.

Angela Wetzsteon began her career early here, wearing short skirts (I am told) to please former county attorney Corn. Angela's Montana Bar License was not obtained until September 9, 2008, but she practiced law on August 8, 2007 in this very building in front of her green Toyota pictured below.

Angela Wetzsteon introduced tampered evidence, after discovery, violated speedy trial, tried the victim, Michael Spreadbury (decorated FEMA officer deployed at a disaster at time of "court date") in absentia [violation of right to confront witnesses, and "offense" was use of justifiable force--protecting property a supposed "inalienable right" in Montana]. Creating jobs--State of Montana

The State Legislature is in session in 2011 and is charged with helping the State create jobs.

While the individual legislature members don't get it, some people in the state really do. We need to stop targeting our own within our 48th ranked justice system. We need to legitimize our law enforcement with a mission of public service instead of abuse, rape, and maliciousness (these have all been documented, attempted with mute response to our congressmen and the 44th President).

When our accident rate is highest in the nation, do employers want to come to Montana? Absolutely not. The remoteness, and the length of travel to come and go, and the climate make it hard enough. What happens when the legal climate, the high rate of lawsuits that drive potential investors away? Schweitzer, Bullock all know these figures, and data yet prefer to continue with blinders on.

So who is actually stopping the progress of the state? Our own justice system officials, and chief executive Brian Schweitzer. It gets worse when the Attorney General refuse to 1) obey laws, rules, and constitutional rights of Americans who live in Montana, and 2) oversight groups like the Office of Disciplinary Counsel from the Montana Bar, and the Montana Judicial Commission do nothing more than pat each other on the back. We are destroying Montana's future by not upholding any standards that foster economic growth.

Montana residents get more desperate for work, more desperate to get more done on the farm, desperate to make visible progress at work to avoid getting laid off, which result in more accidents. Accidents lead to personal injury lawsuits. Lawsuits scare off industry and viable business interests in Montana.

The reputation of our law enforcement, and judicial officials are getting far ahead of Americans who live outside Montana who decide to reside, or vacation within the state. The justifiable police shooting in Hamilton, Montana is a top video on the Internet. As much as we think we operate in a wonderful vacuum, our actions are having very drastic implications that this state may never overcome.

Will the current judicial "generation"walk away and leave the bits for the "survivors" who dare stay in a state without a future? We look for economic causes of our downturn, and they are far removed from the drop in tourism (although our "reputation" doesn't help). The arrogance in the State of Montana will also be its downfall: we have some very bad habits which will not ever convert to jobs, investment, and viable future. Montana will remain in decline until we reform our justice system, reduce the accident rate, and stop abusive governments which prey upon its own people, outside established constitutional rights to unlawfully fill its coffers. Ravalli County can be proud: they are un-knowingly the first to do some very unjust things:

1) Allow a law student to practice law although violated constitutional rights. This is the first time in United States history perhaps the world where this has happened.

4) First President declared wildfire in the year 2000 that brought down the south county timber and made lots of match sticks to look at now.

5) We house the City that does not legally exist, Hamilton, MT.

6) Crime to sit peacefully on public property, convicted to jail with United States flag over courthouse.

Visit the State of Montana soon, just don't ask the Highway Partolman if they got a test score, or if they had probable cause for taking your greenbacks. Jeff Fowler pled guilty to felony theft; isn't it interesting that the powers that BE waited after the election of November 2010 to settle this case? The alleged stealing of ammunition was in early 2009, it all seems too convenient. Read below the strange comment from Sheriff Hoffman of Ravalli County regarding Fowler.

One of my colleagues knew Fowler pretty well. He was in charge of the lock up, where I am going to say multiple Deputies made the ammo theft their "slush fund". The criminals wear badges like the one pictured above. When these deputies watch porn, get in drunken brawls, tamper with evidence to make crime, Ravalli County is out of control for law enforcement. Showing up at a house in the middle of the night for a civil service does not bode well for law enforcement here.

Too bad it leads to malicious prosecution, in a court of law. When local, county, state, federal judges are all in on it--you have a rogue state within the United States that has no reason to be receiving federal funding--to put out our historic annual wildfires amongst other "needs". Our Sheriff, the exalted Chris Hoffman of Ravalli County has threatened his opponent, and a separate citizen running for office. "Watch your step in Ravalli County" says Hoffman.

Well, I'm just 40, and I think I will easily outlive Mr.Hoffman, looking forward to the day I can tell his family and friends that he threatened me while Sheriff, and I am here to tell you about it.

With respect to the Grand Theft AMMO in Ravalli County, Montana within the Sheriff Department, Fowler stated to a State Judge that he did not do it. Hoffman answered to Montana Public Radio that "He does not know why he would say that." I do, its because good cops, and good people are set up to continue the most intense criminal conspiracy, easily covered by state and federal officials protecting Montana.

Ravalli County puts new meaning to the "good old boy" network. The current one is protected through the White House in Washington DC with Deputy Chief of Staff Jim Messina "from Missoula", but actually from Boise, ID originally.

Montana Justice System in Crisis

Being ranked last in the nation for justice is not well known in the State of Montana. Congressmen, Governors, Attorney General, and the FBI feel the problem can persist. Its easier with a staff member in the White House since 2009 helping to cover up the problems....our own Jim Messina.

What happens when "built in protections" in the justice system become more mechanism for abusing rights of Americans who live in Montana? When local judges know the prosecutors, and go their way on bail (8th Amendment), probable cause (14th Amendment), and other determinations (search and seizure; 4th Amendment) ordinary Americans in Montana are not getting their rights upheld.

That might be the reason we lost a Montana Highway Patrolman in Three Forks, MT this week. While the Associated Press (AP) wishes the nation to believe this 56 year old dog trainer was "bitter" from a former snake bite complication, the bitterness is the loss of liberty, the loss of rights, and the loss of control normal people have in their lives due to our out of control criminal justice system in Montana.

In Montana it is big business to place orders of protection, with supposed large federal grants that never seem to make it to the bottom line of municipal budgets. Required paperwork seems to magically appear, and Lee Newspapers are willing to fill in the blanks for a price. We have no justice, or truth.

When an employee of the Attorney General office threatens a person's livelihood and house for questioning a county prosecutor, something is wrong in Montana. That employee is now in charge of the Highway Patrol, and is also Attorney General, Steve Bullock (a Columbia Law graduate).

The MHP did not give test scores in 2008 to applicants "who did not make it" and had two uniformed officers put their hands on their holstered sidearms and asked the "unsuccessful" candidates to leave.

with letters, websites, blogs, and a documentary on justice, the Montana state and federal officials now need to understand that they were given information about the justice system prior to this officers ultimate sacrifice. Denial is the first step, what is the next?

In 2004, I worked for the Nader campaign because a political solution was favorable to a non-political one. That time has passed; especially when the campaign was downed by big dollars which is the opponent we neglect to see.

To whom do you pay student loans: corporate banks. Paying off a car? corporate banks. Mortgage on a house? corporate banks. If you want to contend in state or federal courts: you must hire a corporate lawyer, or else the rules are not the same: The US Constitution does not apply unless you belong to the corporate "club". The buy-in is easy for most Americans: all it takes is a bit of ego....the pay is high, the status is very high. The costs: way too high.

We The People of Montana asked our Congressmen, Governor, and the current US President for assistance with respect to civil rights (yes the black president). We did not get action from any of them, nor the Department of Justice. That does not mean our cause was not without merit, it showed us corporations take top priority, citizens none.

We queried FBI Headquarters in Washington DC the week before the 2007 Blackwater USA shooting in Iraq. A battalion of FBI agents went to Iraq (with corporate type "hazard pay") to protect US CORPORATE interests, not national security, or international relations. Unless you are a corporation, you are nothing in the new America. US Military deaths since 2003 have been to protect corporate interests in the Middle East. American kids are dying for corporations in "wars"to protect, and get positioned for asset allocation when regimes fall.

What shocked me was a recent Charlie Rose interview on PBS with a New York Times reporter. He said the US is in a "pre-revolutionary" position. The lesson we have learned is that our country is now gone. We informed the authorities of problems that they already know exist. We then made an effort to inform the American People: the plight in Montana is the stage for what is to come in the US. White House staff (from Montana), tactics (Romanoff scandal), and a top US Senator (Max Baucus) were given a pass to impose health care reform on the American people. Doctors were arrested in that health care forum who did not agree with Senator Baucus of Montana.

What the Administration does not know is that many have professed to die before purchasing a federally mandated health care plan (note: the arrest for non-compliance of corporate/federal health care triggered resistance). Outer limit of civil war: 2014, the date set by the US government.

When Americans lose their homes to corporate banks, lose their jobs to multinational corporate downsizing, and lose their life savings to the corporate stock market crash of 2008, when will we wake up as a nation: our government has been seized by corporate "people"? When senators need to collect millions to pass go and return to office, who do you think buys them? (corporations).

When our president needs to collect $600M to be elected, who do you think owns him? The TV coverage of the news is paid for by the Gillette razors made outside Boston, the Coca-Cola made worldwide, and the rental car company out of Atlanta. After how long do you think the American people get sold out to corporate interests? It happened gradually, like the Boiling Frog Syndrome: we never felt a thing. Corporations now own the United States.

While I am not an organizer, I am an advanced thinker. The last warnings have come down for the US Government. The "Oath Keepers" refuse to fire on Americans; they are within the military, and law enforcement worldwide. The division between corporate and individual will increase and the conflict will begin. Our country is gone: it will no longer be the Union vs. the Rebels. It will be the corporate paid soldiers like former Blackwater USA vs. the lovers of the US Constitution; with pursuit of happiness, life, liberty and justice for all. The question is, how long, or will "corporate" soldiers be able to fire on fellow Americans?

Ralph Nader may have had something when he ran in 1998: a message that corporate interests closed off our access to our country. It started in 1988 with the closing of the Presidential Debates. It continued in Phoenix, AZ as I saw the corporate lawyers savor the "victory" of eliminating a presidential candidate. That is not a victory, it is a telling sign that our country, and select people in it are willing to sell out to corporations. What is it telling you?
