Ravalli County Montana

This letter was published on Wednesday April 17, 2013 by the Bitterroot Star Weekly available at www.BitterrootStar.com.  The letter is not available online due to the Editor saving me from defamation from the knuckledragger mentality, and the criminal conspiracy of the government actors which includes the Ravalli Co. Sheriff Office.  My phones continue to be monitored although I have never committed a crime, nor ever will.

Its scared officials violating the #1 Criminal priority of the US Justice Department, and being caught at the criminal game they've played since 1893--120 years.

True Freedom continued.

I’d like to answer the letter on true freedom from April 10, 2013.  It loosely defined freedom when a person takes responsibility for themselves, their property, and accepts the societal repercussions for their actions.  The author stated if Hamilton & Ravalli Co. were illegitimate government then the people must rebuild and shape a lawful government to better serve the people.  My question asks which is more dangerous: A group of people making believe the Government doesn’t exist (Freemen) or a group of people pretending they are the government (Hamilton & Ravalli Co. governments)?

Incorporation paperwork for a Montana municipality is required to be available for public inspection, yet currently absent for Hamilton, and worse: publically claiming a year after the county was formed.  Every county in Montana is required to have a legitimate seat; Ravalli Co. presently is out of compliance with Montana law, and cannot continue without this requirement.

To the people so inclined to create a lawful government, this power is vested to you in the Montana Constitution Art. I s.1: “All political power is vested in and derived from the people. All government of right originates from the people, is founded by their will only, and is instituted solely for the good of the whole.” Section 2 states the people may alter, or abolish government whenever they deem it necessary.  Montana statutes for municipal incorporation give specific instruction for procedure: a census, petition, notice of election, defining municipal boundary, and other instructions that anyone can follow.

As I read common letters from the Bitterroot Star (County Planning Board, public meeting notice, public information) these problems would be eliminated as a lawful government would uphold these laws, and other requirements instead of finding ways that suit a group (commissioners) or an individual (county attorney).  Current City of Hamilton, Montana residents can decide the future of their City, and whether to provide a county seat, or to revert to its annexed status as a Missoula County outpost.  A newly created municipality can create a new county at the people’s direction as vested with that power in the Montana Constitution.

We cannot continue the same old tradition of taxing the people, and forcing a criminal “mill” which includes 15 police officers as a city of 4,000 that dictates 4; unsworn, unlicensed prosecutors, in a locked compound investigating mostly fiction of their own making.  Do 12-15 felonies occur every week in “Ravalli County”?  Watch the 21st District Court Wednesdays and Thursdays at 9am and see the mill for yourself.  The 2005 suicides did not evoke a radical change of attitude: both county Judges are still on their respective benches, and mistreatment in the infamous Ravalli County Detention Center (RCDC) has not improved, nor did Sheriff Hoffman keep his 2005 claim to the New York Times of not running for office again.

I accept responsibility for sitting on public property, speaking in public without threat, writing with sidewalk chalk without threat, and protecting property. Ravalli County knowingly failed to protect from a life threatening situation, ignored evidence, put a law student “prosecutor” in a courtroom, and made these normal acts into sensational criminal acts with the help of a “newspaper”.

like assembling on public property.

The real question becomes: when is the denial, the vilification (see NAZI psychology) and the void by local government not serving the people going to drive people to form government units that comply with Montana law?  As imposter local governments [City Seal:1894; County Seal:1893 FAIL] accept municipal funds from the public, they are engaged in municipal fraud and may get removed from their public office.

Local city and county governments can seal any person’s fate by use of tampered evidence, or other unlawful process (violation of right) condoned by every public official in Hamilton, and Ravalli Co.  A touted candidate for Mayor, a former County Commissioner ignored responsibility for the Ravalli Co. Road Department; the people paid for an unnecessary lawsuit that could have been avoided.  We deserve sworn public officials unwilling to comply with the Ravalli lawlessness, who listen to the will of the people which may include dissolving all government in this area, or alter the current government for true freedom.

Montana Freemen were right

This letter published in the Bitterroot Star Weekly Newspaper in Stevensville MT is how local governments are not lawful in Ravalli Co. Montana where Montana Freemen had located.

Freemen were right about local government

In 1996, the Montana Freemen were a well-known group. I’ve heard Ravalli County Sheriff Printz rode out on horseback to negotiate their surrender, later to win a court case in the US Supreme Court letting local governments off the hook for paying for firearm background checks. While it is wrong to threaten government officials, write bad checks, or place liens on public officials, the Montana Freemen were right about Ravalli County, Montana. It was about the only thing they were right about.

Marcus Daly wanted the county seat for Ravalli County, Montana to be in Grantsdale. Today it is purported to be in Hamilton. It isn’t. James W. Hamilton annexed the City of Hamilton to Missoula County in September of 1890, confirmed today on the official plat map of the City of Hamilton.
In August of 2009, I enjoyed public property at State and 4th Sts. in Hamilton. The then City Attorney refused to swear an oath for six years to the office, and charged criminal trespass on public property. In the preparation of my defense, I bought a certified map of Hamilton from the Ravalli County Clerk which showed me the truth about Hamilton and Ravalli County.

Any person today can look at the floor mats in the City Hall (223 S. 2nd Street, Hamilton), embossed with the City Seal and hopefully won’t be charged with a crime. The mat attests to incorporation in 1894 without official paperwork to incorporate a municipality in Montana law [MCA 7-2-4101 to 4105]. Current City of Hamilton Mayor, Jerry Steele, verified in official meeting in 2009 captured on video (available: www.BeneaththeBeauty.com ), that the city has no incorporation paperwork. The Montana Legislature formed Ravalli County in March 1893. Look in the foyer of the Ravalli County Administrative Building (215 S. 4th Street, Hamilton) for the painted County Seal to prove this date. Hopefully, you will not have your employer intimidated for doing so, or be “investigated” for entering public property—that we all pay for.

So the Montana Freemen were right to challenge Ravalli County in 1996 due to mistreatment by government officials, and it continues today with Commissioners overlooking criminal conduct in the County Attorney’s Office, the Sheriff’s Office, and their own lawful existence.

I wrote a letter to Governor Schweitzer which came back in the form of mockery from the Missoula Independent as word of my letter to the State’s chief executive was published. The US Justice Dept. FBI priorities are established to trigger activity; their top criminal priority is public fraud of taxpayer funds. The (unincorporated) City of Hamilton extracts $13.5M from taxpayers without lawful status, and Ravalli County seeks $16.2M which constitutes $30M in 2013 of public fraud. It happens every year, without the consent of taxpayers in Hamilton and Ravalli County. All of the government officials go along either knowing or not knowing about the public fraud.

Montana law [MCA 7-2-2103] says that a county cannot be established without a legitimate seat. Commissioner Kanenwisher’s quick departure is suspect, as he was made aware of this problem and decided to further his nursing career out of state – immediately. As Hamilton never incorporated, and Ravalli County was established unlawfully by the legislature a year before the City of Hamilton claimed incorporation, it is clear that local government is not on the up and up.

While the Freemen were attempting to disqualify all governments, at least they were right when it came to local government in this area. When the FBI is quick to squelch outliers like the Freemen, what happens when they ignore their top criminal priority of public fraud? We are all Freemen now.
Ravalli commissioners are aware of their unlawful status, but with salaries of $50,000/year plus benefits, it is easy to ignore the truth. The Montana Freemen were onto something, and probably didn’t even know it. They were right about local governments in Montana. As State and Federal governments ignore their oaths to taxpayers, it is time to think like the Montana Freemen until our tax dollars are going to lawful governments. Local government officials are doing nothing more than engaging in high value white collar crime, and allowing lawlessness of their employees using our public funds.

2014 Update:  We welcome the FBI to Ravalli Co. to find what they can, and attempt to bring law to a very lawless place.  Many people lost their lives, and livelihoods to criminals who have done nefarious things with public funds in that area.

Open letter to Hamilton City and Ravalli County residents
This letter is communicate to readers of the Bitterroot Star, and the Bitterroot valley a situation that our public officials (including Governor Brian Schweitzer) chooses to completely ignore due to the “headache”. A copy of this letter is being sent to Mayor Engen of Missoula, who was gracious enough to meet with me in 2009 and might get a better reception with the Governor, and the Missoula County Commission.
The City of Hamilton claims they “incorporated” in 1894. Ravalli County was formed by the Montana Legislature on March 3, 1893. Hopefully by the last two sentences, many people are doing a double take. A county seat such as Hamilton cannot be formed a year after it’s county was.
As tax season is in full swing in April, many of us pay respective taxes to these local governments in this area. The problem arises as the requisite paperwork for Hamilton’s existence are absent, and are non-existent as was admitted in official meeting August 2009 by Mayor Jerry Steele and captured in the documentary “Beneath the Beauty” .

Available: www.BeneaththeBeauty.com
Montana Code indicates that a municipality in Montana such as Hamilton must have a census, petition, record of election, and notice of election to incorporate as is found in MCA§ 7-2-4101 to 7-2-4105. These items must be open to public inspection. Ms. Rose Allen Hamilton City Clerk, Ms. Regina Plettenberg Ravalli County Clerk do not have these items; we inspected the record prior to the 2009 Mayor election, including the Ravalli County Museum.
I purchased a certified plat map of the City of Hamilton on February 25, 2010. While I only wanted to authenticate the city property as publically owned, the map glaringly told a different tale: James H. Hamilton annexed the City of Hamilton to Missoula Co. by sworn affidavit on September 4, 1890. The map is available by searching the Youtube® website for “City of Hamilton, Montana” and viewing a short video of this map.

As we prepare for paying taxes on our properties to the “City” of Hamilton, and Ravalli County, the implication is that we are paying money for tax to a group of people pretending to have a government. The Feds like to prioritize their investigations, public or municipal fraud (misuse of public tax dollars by local government) is the number one (#1) criminal priority, followed by election fraud. As commissioner signs are put up, and Regina Plettenberg prepares for another county election (the #2 criminal priority) this area’s government is in denial of the realities and problems they are truly in.
Ravalli County government cannot exist without a legitimate seat per Montana Code Ann. MCA§7-2-2103. Matt Kanenwisher, and Suzy Foss have been consulted as to this issue and they assure me they take it seriously. My faith in a county attorney making opinion to eliminate his own job is tenuous at best. Instead of addressing the commission, I am electing to write this open letter to inform the public at large.
The Bitterroot Star, myself, the Ravalli County Watchdog site, and Judge Jim Haynes made opinion that public information is not released, nor is public money spent with proper and lawful public notice in Ravalli County. As law enforcement cannot restrain from tampering with evidence, nor students from practicing law, or a city attorney swearing an oath for seven years in office, a common theme is there: unlawful, unincorporated local governments have no obligation to obey the law or respect local taxpayers.
I have queried the Missoula Commission of their ownership of Ravalli County by annexation of Hamilton in 1890. Their response: they will let the Ravalli County Commission take the lead. A popular tactic is to “hold our breath” and wait for an issue to subside; your voice is needed now. As a messenger, it did not go so well as I attempted to put a letter to President Obama concerning the lack of civil rights in this county, and the ministrations of local law enforcement; ten to fifteen million readers are aware that Ravalli County has no incorporated seat. Only until recently has the connection been made regarding actual ownership of the City of Hamilton and the unlawful nature of Ravalli County by Montana Law.

The Bitterroot Public library in criminal conspiracy with Hamilton MT Police

The Montana US President letter: banned from the Bitterroot Public Library, false publication in the Associated Press with aleged involvement by the Montana Supreme Court, and alas, the City of Hamilton does not exist.
[The Bitterroot Public Library gets more than $500,000/yr from the taxpayers in Ravalli County and pays $1 to the "City" of Hamilton for space by fraud]

http://wethepeoplemt.blogspot.com/2013/01/montana-us-president-letter-2009.html
While I care not for the partisan issues raised locally, I do care for the public taxpayer, and the lawful status of our governments. An unincorporated city cannot have elections, pay employees, or collect taxes. The same can be said for Ravalli County government. The Commissioners are not too keen on putting their pencils down or making efforts with the City of Hamilton to lawfully incorporate (or re-incorporate).
I ask that this issue is not allowed to be ignored. The incorporation process will ask people within the City of Hamilton if incorporation is the right move.
As a city resident, my choice would be to emulate Seeley Lake: no government other than Missoula Co. Are we better without any local government ? My opinion is that the City of Hamilton, and Ravalli County do more harm than good with our tax dollars. The staff of these governments like to gang up on, and abuse the very taxpayers that pay their salaries as public officials of governments locally that dont lawfully exist.
It is irresponsible for the Montana Governor to ignore this critical issue. The same can be said for the Missoula Commission: turning down tens of millions of tax revenue due to it being a “headache” is a disservice to its constituents. As a taxpayer, make your voice known to your unlawful governments to follow Montana Law, or disband.
